Form DTF-802, Statement of Transaction - Sale or Gift of Motor Vehicle, Trailer, All-terrain Vehicle (ATV), Vessel (Boat), or Snowmobile is a legal document signed in New York State when a vehicle is received as a gift or when sales tax was not collected at the time of the transaction. It accompanies the bill of sale and notifies the authorities about the sale. A Statement of Transaction is used to report the sale of motor vehicles, trailers, ATVs, snowmobiles, boat/trailer combinations, and separate watercraft.

Who Needs to Submit Form DTF-802?

When you sell or buy a vehicle in the state of New York, you are required to sign a DTF-802 Form in addition to Form MV-912, Vehicle Bill of Sale. It is completed by both parties - the seller must complete the affidavit of sale or gift on the second page of the form and then sign the document. Then, the documentation is brought by the buyer to the Department of Motor Vehicles (DMV) when applying for a new title and registration.

Provide the following details in the New York State DTF-802 Form:

1. Vehicle Information. Enter the type of vehicle, and indicate the length of the boat if you are selling a vessel. Write down its year, make, model, and vehicle/hull identification number. If the transaction involves an ATV or snowmobile, specify its delivery or storage location respectively.
2. New owner information. State the full name, address, and social security number of the purchaser.
3. Previous owner information. Write down the seller's full name and address.
4. Transaction information. Indicate the date of the transaction. Select the appropriate box to certify the relationship of the buyer to the seller. If a vehicle was given to a family member or sold at below fair market value, check the appropriate box.
5. Purchase information. State the purchase price - the amount of cash payment, the balance of payments, and the value of the property. Enter the tax rate and sales tax due. The purchaser must certify these statements and sign the form.
6. Affidavit of sale or gift of a motor vehicle, trailer, ATV, vessel (boat), or snowmobile. The seller must complete this section if the vehicle was given as a gift, sold below fair market value, or received by an individual other than a spouse, parent, or child. The previous owner must indicate the cash payment received and state if there were any additional conditions for the sale or gift. If the seller is a corporation or business and the vehicle was used in relation to employment, mark an X in the appropriate box and explain the situation on the line below. Once all the lines are completed, the seller signs the form confirming the credibility of the statements.

Where to File a DTF-802 Form?

Once you complete and sign a Statement of Transaction, you have to submit it to a local DMV office along with the original Certificate of Title and Bill of Sale.
